By accessing or using the FarePlay Golf platform, mobile application, or website (collectively, the "Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use the Service.
FarePlay Golf, LLC ("FarePlay," "we," "us," or "our") reserves the right to update these Terms at any time. Continued use of the Service after changes constitutes acceptance of the revised Terms.
FarePlay provides a GPS-powered food and beverage ordering and delivery platform for golf courses. The Service enables golfers to place orders from their mobile devices and enables golf course venues to manage menus, carts, staff, and payments.
To use certain features of the Service, you must create an account. You agree to provide accurate, current, and complete information during registration and to keep your account information up to date.
You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account. You agree to notify FarePlay immediately of any unauthorized use of your account.
When you place an order through the FarePlay app, you agree to pay the listed price for all items ordered, including applicable taxes, fees, and gratuity. All payments are processed securely through our third-party payment processor, Stripe.
Prices are set by the individual golf course venue and may change without notice. FarePlay is not responsible for pricing errors made by venues.
Refund policies are determined by each venue. If you have a dispute regarding an order, please contact the venue directly or reach out to FarePlay support for assistance.
Golf course venues using FarePlay to manage their food and beverage operations agree to provide accurate menu information, honor orders placed through the platform, and comply with all applicable food safety and alcohol service regulations.
Venues are responsible for the quality and safety of all food and beverages served through the platform. FarePlay acts as a technology provider and does not prepare, handle, or deliver food or beverages.
The FarePlay app uses GPS and location services to determine your position on the golf course for order delivery. By using the app, you consent to the collection and use of your location data as described in our Privacy Policy.
Accuracy of GPS location may vary based on device, environmental conditions, and other factors. FarePlay is not responsible for delivery delays caused by inaccurate location data.
You must be at least 21 years of age to purchase alcoholic beverages through the Service. By placing an order for alcohol, you confirm that you are of legal drinking age. Cart operators may request valid identification upon delivery and may refuse to complete the delivery if proper identification is not provided.

The Service, including its design, features, content, and technology, is owned by FarePlay and is protected by copyright, trademark, and other intellectual property laws. You may not copy, modify, distribute, or create derivative works based on the Service without our prior written consent.
The Service is provided "as is" and "as available" without warranties of any kind, either express or implied. FarePlay does not warrant that the Service will be uninterrupted, error-free, or secure.
To the maximum extent permitted by law, FarePlay shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising out of or related to your use of the Service, including but not limited to loss of profits, data, or goodwill.
You agree to indemnify and hold harmless FarePlay, its officers, directors, employees, and agents from any claims, damages, losses, or expenses arising out of your use of the Service or violation of these Terms.
FarePlay may suspend or terminate your access to the Service at any time, with or without cause, and with or without notice. Upon termination, your right to use the Service will immediately cease.
These Terms shall be governed by and construed in accordance with the laws of the State of Delaware, without regard to its conflict of laws principles.
